Providing relevant information is a key part of ‘good faith’ bargaining
CPSU welcomed the Fair Work Act, which says parties need to deal with each other in good faith. This includes disclosing relevant information in a timely manner.
The Library is the first Agency to resist providing relevant information
Instead of responding to CPSU requests, the Library has chosen not to provide relevant information including the number of employees at pay points; pay rates and bonus payments available to employees on AWAs or s24 Determinations; and current financial statements including amounts paid or due in regard to performance pay bonuses. The Library is the first Agency to take such a hard line in withholding relevant information.
CPSU acting to protect ‘good faith’ bargaining
To protect your right to be able to make an informed choice, CPSU has formally notified the Library that we view their failure to provide information as being inconsistent with the Fair Work Act. This is the first time CPSU has had to enforce this provision. We have invited management to remedy this breach by providing the information we believe is relevant to ongoing discussions for a new Enterprise Agreement and our ability to properly assess the current offer.
