Know your rights in AirServices - hours of work


This is the first of a series of factsheets aimed at improving understanding of how the new AirServices agreement works.

37 hours per week

  • For flex, standard hours and shift staff, your ordinary hours of work are now 37 hours per week, or 7 hours, 24 minutes per day.
  • If you are on flex, you may accrue up to 10 hours flex credit with the agreement of your manager.
  • If you are a TAS employee on flex, you may accrue up to 22hrs and 12 minutes flex credit.
  • The maximum cap for either can be raised in exceptional circumstances, or due to local arrangements.

Span of hours: 7am – 7pm

  • For staff on flex and standard hours, the new span within which these hours can be worked is from 7am to 7pm, Monday to Friday, excluding public holidays.
  • Work outside these times is additional hours, except for staff on shifts.

Maximum 10 working hours per day and a break after 5 hours

  • For flex, standard hours and shift staff, you are limited to working 10 hours per day. Any time worked beyond this is additional hours.
  • You are also entitled to a 30 minute unpaid meal break after 5 hours.

Changes to working hours by agreement

  • For staff on flex or standard hours, your regular hours of work may only be changed by agreement between you and your manager. This applies whether it is you or AirServices initiating the change.
  • If you are on shift, the normal pattern of start and finish times cannot be changed without consultation, and you must be given at least 7 days notice of any changes to your shift.

Additional hours

  • If you are on flex or standard hours, additional hours can occur when
    • you are directed to work outside the span of hours
    • where there is an express direction to perform work in addition to agreed working hours and you have already worked 7 hours 24 minutes that day.
       
  • If you are on shift, additional hours can occur when
    • you are expressly directed to perform duty when rostered off
    • you have had less than 7 days notice of a roster change.
       
  • If you are a fixed part-timer, additional hours can occur when you are expressly directed to perform work in addition to your normal hours of work.
     
  • Additional hours are paid at o 50% loading for the first 3 hours
    • 100% loading for any hours after the first 3
    • 100% for any hours on a Sunday, and 150% for hours worked on a public holiday.

None of these entitlements came from nowhere – they were the result of a hard-fought campaign for better working conditions run by AirServices staff over the past year.
